A contempt plea has been moved at the Madras High Court against the Feb 2 GO on the basis that it is totally against the spirit of the Supreme Court order. Advocate R Pugalendi in his plea had contended that the Supreme Court had stuck down Section 6A (1) of Delhi Special Police Establishment Act as invalid.

The section had mandated Central Government approval to con- duct inquiry into any offence, committed by Joint Secretary and officers above that level. He further contended that when the earlier GO, which conferred special privileges and treatment on All India Service Officers working in Tamil Nadu against corruption charges was challenged, the MHC on October 7, 2015 sought the State to revisit and evolve a non-discriminatory policy.

However, ignoring the assurance, the government had come up with a new GO, which instead of confining to just All India Service Officers had roped in all the public servants. But the part which makes it mandatory for DVAC to seek and consider remarks of the Govt before taking up the probe still prevailed, Pugalendi contended.

He said the present GO was totally contrary to the Supreme Court order and sought MHC to initiate contempt proceedings against Tamil Nadu Government.
