A division bench comprising Justice S Nagamuthu and Justice V. Bharathidasan, while dealing with a habeas corpus plea moved by a mother seeking to produce her two daughters, said “It is a disputed question of fact as to whether the two women are really detained illegally in Isha Foundation or they are there on their own volition.
In our considered view, simply acting on the allegations made by the petitioner, we cannot direct the police to produce the women before this court so as to expose them.” The bench on seeking the district judge to submit his report on or before August 12 also held that, “In our considered view, such production of the women before this court may amount to invasion into the modesty and privacy of the individuals. therefore, without harming their modesty and their privacy, the facts have to be verified.”
The petitioner had contended that both her daughters were kept as captives in the illegal custody of Isha Foundation. She expressed apprehension that they have been physically and mentally tortured by the members of the Isha Foundation.
