    Plea for CBI probe in Swathi case dismissed

    Even as the probe into the murder of Swathi is continuing, the Madras High Court on Friday dismissed a plea seeking transfer of investigation to the CBI.

    The plea was filed by accused Ramkumar’s mother alleging that the investigation was not proceeding in the right direction and that her son is being falsely implicated by the police. Justice P N Prakash, who dismissed the plea after perusing the case diary, held that “This court does not find any infirmity in the investigation being conducted by the Assistant Commissioner of Police, Nungambakkam station, warranting transfer of the case to CBI”. 

    However, the judge also recorded the aspect that some witnesses have identified Ramkumar as the assailant during the test identification parade held by the IX Metropolitan Magistrate on July 12. Similarly, the judge on holding that the petitioner reliance on news items from print and other media sources cannot form the basis of transferring a case to CBI, said there was no credible material to show that that a special team of police officers had gone to Karnataka to investigate the case. 

    The judge also negated the petitioner allegation that more than one person was involved in the attack going by the cut injuries, saying “it is not axiomatic that if more than one stab injury is found, more than one person is involved in the attack.” Justice Prakash also held that from a reading of the case diary, this court finds that though the investigating officer has his ears to the ground, yet, he had so far proceeded in the basis of objective materials obtained during investigation.

    Construction case: Corporation commissioner summoned
    The HC has summoned the Corporation Commissioner to appear before it and explain the action taken in a case wherein a person who procured an order of de-sealing his premises for demolishing the unauthorised portion instead proceeded with the illegal construction.
    The first bench, comprising Chief Justice Sanjay Kishan Kaul and Justice R. Mahadevan, said “The affidavit filed by the Corporation on Sept 2 affirms that final orders have been passed against seven delinquent officer, who failed to stop the unauthorised construction. But no details have been given.” Also, the bench on pointing out that “On our query as to whether the corporation has proceeded against the building owner Devaraji, neither any affidavit has been filed nor there is a satisfactory answer”. Seeking the Corporation to file a proper affidavit, the bench directed the current Corporation Commissioner to remain present in court on the next hearing date and listed the case to Sept 23. The matter relates to the construction carried out by Devaraji on Plot No: 448, 7th South Cross Street, Kapaleeshwarar Nagar, Neelangarai, Chennai which is behind the plot of the petitioners, which was sealed and locked by the officials for gross deviation in construction.
